www.bhaskarad.com (hereinafter also referred to as the “said Website”) is an internet-based platform which provides online facility to book Classified Ads with content creation, formatting and updating to the end user. It works as a bridge between the customer and Newspapers published by DB CORP LTD in different languages (hereinafter also referred to as “Service”). The said Website is owned/operated by DB CORP LTD, a Company incorporated and existing under the laws of India, having its registered office at Plot No. 280, Sarkhej-Gandhinagar Highway, Near YMCA Club, Makarba, Ahmedabad - 380 051, Gujarat and Head Office at Dwarka Sadan, 6, Press Complex, M P Nagar, Bhopal - 462 011, Madhya Pradesh (hereinafter also referred to as “DB CORP”). DB Corp shall include its group companies and affiliates.

This user Agreement sets out the legally binding terms (hereinafter also referred to as “Terms of Services or TOS”) for your use of the said Website. This user Agreement may be amended or modified by DB Corp from time to time, effective upon use of the said Website. In addition to this Agreement and depending on the Services opted for by the User (hereinafter also referred to as the “Subscriber/Advertiser”), the User shall be required to read and accept the relevant terms of services for such Service, which may be updated or modified by DB Corp from time to time. Such TOS shall be deemed to be a part of this Agreement.

If you wish to use the Services provided under the said Website, you may have to register to avail the Services. Use of the said Website is offered to the User upon condition of acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the said Website from time to time. For the removal of doubts, it is clarified that use of the said Website by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not use the Website.

Additionally, DB Corp may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service. The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies relating to offers or any specific services.

Further, you are also cautioned to read the FAQs before registration. If you visit or sign up with the said Website, it is presumed and understood that you fully accept and are bound by all these Terms & Conditions, and also deemed to have gone through the FAQs.

MODIFICATION OF TERMS & CONDITIONS OF SERVICE

The said Website may at any time modify the Terms & Conditions and TOS including but not limited to the charges or tariff of the advertisements without any prior notice or intimation to you. You can access the latest version of the Terms & Conditions and TOS at any given time. You should regularly review the Terms & Conditions and you are expected to do so at regular intervals. In the event, the modified Terms & Conditions are not acceptable to you; you should discontinue using the services. However, if you continue to avail the Services provided by the said Website, you irrevocably and unconditionally agree to accept and abide by the modified Terms & Conditions.

ELIGIBILITY

You represent and warrant that you are competent and eligible to enter into a legally binding agreement and have the requisite authority to bind the other party to this Agreement. You shall not use the said Website if you are not competent to contract under the applicable Indian laws, rules and regulations. By registering on the said Website, you explicitly understand and agree that:
- The minimum age for registering is 18 years;
- You are not disabled by any law from entering into a contract;
- You have gone through the Terms and Conditions and agree to be bound by them; and
- To avail the Services, you must continue to maintain at your own sole cost: (a) all the necessary equipment including a computer and modem, smart phone etc. to access the said Website/avail Services; (b) own access to the World Wide Web. You shall be responsible for accessing the Services and that access may involve third party fees including, airtime charges or internet service provider’s charges which are to be exclusively borne by you.

REGISTRATION
1. Registration is not automatic but optional. However, to avail the Services, it is imperative to register on the said Website. As a part of registration process, you agree to provide complete and accurate registration information (the “Registration Data”) and time to time update the same. 2. If you proceed to register yourself on the said Website, you agree and undertake at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, you agree not to use any other party's user id and password for any purpose whatsoever without proper authorization from such party. You are responsible for the security of your password and for all transactions undertaken using your password through our service. The password entered by you is transmitted in one-way encrypted form to our database and stored as such. Thus, the password will not be known to any party including DB Corp. You are required to confirm that you are the authorized holder of the credit/debit card or the original account holder of other modes of payments used in the transactions you make using the DB Corp services through the said Website. DB Corp will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit /debit card number/ account details for using the said Website.
3. You also agree and undertake to immediately notify DB Corp of any unauthorized use of the user's password or user id and also ensure that you log off at the end of each session at the said Website. DB Corp shall not be responsible for any, direct or indirect, loss or damage arising out of the User's failure to comply with this requirement.
4. You also agree to: (a) provide true, accurate and complete information about yourself and your beneficiaries as prompted by the registration form ("Registration Data") on the said Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or DB Corp has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, D B Corp has the right to suspend or terminate your registration and refuse any and all current or future use of the said Website and/or any Service.
5. Furthermore, you grant DB Corp the right to disclose to third parties Registration Data to the extent necessary for the purpose of carrying out the Services.
6. You give the said Website exclusive, worldwide, royalty-free, irrevocable, sublicense able (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or Registration Data displayed in the user listings. "Individually Identifiable Registration Data" shall mean that subset of "Registration Data" which can be reasonably used to identify a specific individual such as their name, address, phone number, etc. The Registration Data shall be deemed to be the property of the said Website. The User shall take all reasonable efforts to ensure that it is accurate and complete and not misleading in any way.

TERM

2. The said Website at any stage at their option and discretion, has the right to refuse/reject/terminate/cancel the registration without assigning any reasons. The said Website may terminate your access to their site and/or your registration and/or services for any reason effective upon sending you a notice on the e-mail address and/or by intimation through SMS on the mobile number you have provided in your application for subscription or any other such e-mail address/mobile number as you may later provide to the said Website. However, the said Website reserves the right, in its sole discretion, to terminate or restrict your access to the Site and the related services or any portion thereof at any time, without prior notice.
3. DB Corp hereby grants the User, a non-exclusive, non-transferable, limited license to use the said Website, subject to the unconditional acceptance of the Terms & Conditions governing the said Website.

USE OF COOKIES

The said Website uses technologies such as cookies to collect the information provided by the user. Cookie is a piece of data stored on a User's computer. The said Website uses session ID cookies to confirm that users are logged in. Session cookies terminate once the user closes the browser. The said Website also uses persistent cookies that store other information to make it easier for you to login when you come back to the Site. By using the said Website, you agree and consent to use of cookies for viewing, using and visiting different menus in the said Website but you can also configure your browser to block cookies if you so desire. CONTENT
1. You agree that the contents of the advertisement given by you are true and correct and that nothing has been concealed from the said Website and are in compliance with the laws in India. The Advertiser stands by the content of the said advertisement and indemnifies the said Website and DB Corp against any legal action that may follow because of the publication of the said advertisement.
2. All information of whatsoever nature received from the Advertiser is taken in good faith, without suspecting the bonafide of the Advertiser. The contents of the advertisement are believed to be true and correct and in compliance with the laws of India.
3. Apart from what is stated above, the content provided by you through Bhaskarad.com platform shall go through review process. The content will be reviewed and approved, or relevant feedback will be given to the Subscriber for modification. You can check the status of your advertisement through the Track Id (a unique number provided to you after booking the ad for checking the status: its acceptance, feedback/suggestions) and make suggested changes if any and re-submit. Post Approval, the Advertisement will be published as indicated and confirmed.
4. You understand and agree that the said Website reserves its sole right to accept or reject any content of the advertising materials. It may delete or reject any content in whatever form such as writings (including words /phrases), photos and profiles which are illegal, pornographic, obscene in nature, malicious, vulgar, provocative, against public interest, discriminative, which are, in the sole judgment of the said Website, in violation of the Terms & Conditions or which might be offensive, false, illegal, or that might violate the rights, harm, or threaten the safety of the said Website and/or its Subscribers and/or general public at large.
5. Ads should not contain any provocative content related to caste, creed, religion, nationality, etc.
6. The Advertisement preview shown to the User is an indicative preview of the ad text only and it may at times differ from the actual published advertisement. This may come about as a result of technology and/or because of 'Pagination of Advertisement' by the concerned department of the particular newspaper in which such advertisement is published. Such change is beyond the control of the said Website and DB Corp is not and will not be responsible in any manner whatsoever for any such change brought about by such subsequent formatting and displaying of the Advertisement at the time of such publication and no dispute in this regard will be entertained either in the form of refund or for free insertions or in any manner whatsoever from the User.
7. Appointment or interview ads using name of the renowned and listed companies are not allowed, for example: “Wanted candidates for Reliance”, will not be accepted. Some of the Renowned companies are listed as under:

8. We provide a multilingual ad booking facility. Advertisements are booked in 4 languages, namely: Hindi, English, Marathi and Gujarati.
9. An Advertisement can be booked through the said Website before 90 days at the earliest and not later than 4:00 PM a day prior to the date of publication.
10. The Subscriber receives a notification containing the status of his ad on his registered mobile no./Email ID.
11. DB Corp is not responsible for the authenticity of the content/picture of the Ad or any compliance to the laws of India which will be the sole responsibility of the User / Advertiser.

SMS FACILITY
1. Bhaskarad.com provides/extends the service of SMS to its users/advertisers/surfers based on the information provided by you at the time of registration, with the help of third-party telecom service providers.
2. SMS sent by customer to customer or by one party to another will not be the responsibility of the said Website. Verification and acceptance of SMS and its content will be the sole responsibility of the end user/recipient.
3. In case you forget the password for login, you need to enter the mobile number and captcha, then click the submit button. Entering OTP received by SMS will allow you to reset the password for accessing the services.

PAYMENT
1. The said Website is an online platform and thus works under online payment mode only. There is no provision for offline/cash payment. The said Website has tie-up with “CC Avenue” Gateway (hereinafter referred to as the “Payment Gateway”) for payments in online mode.
2. A link has been provided on the said Website to make the payments through the Payment Gateway. This Payment Gateway, though linked to the said Website, operates independently. Therefore, the said Website will not be responsible or liable for any failures of payment transactions.
3. The Subscriber proceeds for payment after reviewing the final payment quotation. Somehow if the Subscriber is not able to complete the payment and the said Website receives the failed payment status, then it will display failure message with reason received from payment gateway. In any such cases, the said Website will ask the Subscriber to retry for payment.
4. GST will be included (shown separately) in the amount payable by you, and you have the option to provide the GSTIN number while making payment so that it is printed on the invoice.
5. The said Website accepts all types of debit/credit cards, internet banking/payment wallets and other available modes of payments. Charges for Ad booking are required to be made in advance.
6. The said Website does not store any Subscriber’s payment credentials.

THIRD PARTY SITES
1. Some of the sites to which you may link from the said Website are owned by advertisers, service providers, or other third parties (collectively “Third Party Sites”). It is your responsibility to monitor when you have accessed a link to a website that is not part of the said Website, and DB CORP does not take any responsibility or obligation to expressly notify you (via a pop-up or other interstitial display) when you are linking to a Third Party Site.
2. DB Corp is not responsible for any form of transmission, whatsoever, received by the User from any such Third Party Sites. DB Corp is providing these links to the User only as a convenience, and the inclusion of any link does not imply endorsement by DB Corp or the Website of the Third Party Sites or any association with its operators or owners including the legal heirs or assigns thereof. Third Party Sites may include, without limitation, sites of advertisers, other search and listing service providers, information and referral sources, rating services, geographical location and navigation services, businesses which allow you to bid for and/or purchase products or services, and other sites of general or specific interest.
3. DB Corp does not make any representations regarding the availability and performance of the said Website or any of the Third Party Sites to which the said Website links. When you click on advertiser banners, sponsor links, or other external links from the said Website, your browser automatically may direct you to a new browser window that is not hosted or controlled by DB Corp. DB Corp and its affiliates are not responsible for the content, functionality, errors, omissions or representations or technological safety of these Third Party Sites.

CONDUCT
1. The said Website’s service may be used only for lawful purposes. Transmission, distribution or storage of material, or conduct in violation of any applicable local, state, Central or foreign law or regulation is prohibited. This includes without limitation any unauthorized use of material protected by patent, copyright, trademark or other intellectual property right; material that is obscene, defamatory or libelous; constitutes an illegal threat; violates rights of privacy or publicity; or violates other laws. The user may use the information on the said Website only to the extent necessary to facilitate the said Website’s related transactions.
2. You are prohibited from data mining, scraping, crawling, or using any robot, other automatic device, script, software, technology or processes that send automated queries to the said Website, or from using other similar methods and tools to gather or extract data from this Website, without our prior written consent, which consent may be withheld and withdrawn by at any time, with or without notice, in DB Corp’s sole discretion.
3. The said Website has made available the Service for publications under D. B. Corp Limited only. We do not catter Ad booking services for Jabalpur Dainik Bhaskar, Nagpur Dainik Bhaskar, and Sub editions(Jabalpur, Satna, Chhindwara, Singrouli in MP & Nagpur in Maharashtra) of these locations, as these are not part of D.B. Corp Ltd. Any of our packages(i.e. All India, All MP, All Maharashtra), do not include the locations mentioned above. We provide the publication services for only those locations which are available for selection through the portal. Kindly confirm for the locations under Package bookings("All" and Matrimony) before booking, on our toll free number.

COPYRIGHT POLICY
1. All the information and contents on the said Website are owned/exclusive property of DB CORP and or its affiliates, and protected under the Copyrights Act, 1957 along with the Copyright Laws of all other countries worldwide. All rights of the said Website are reserved and no part of the said Website shall be reproduced, stored in a retrieval system or transmitted in any form or by any means - electronic, electrostatic, magnetic tape, mechanical, printing, photocopying, recording or otherwise, including the right of translating in any language without the prior written consent of DB CORP and/or its affiliates.
2. The User will be held responsible and liable for all the consequences arising out of any violation of law, infringement of copyrights, proprietary rights and intellectual property rights, including damages, attorney fees and expenses.
3. Further, the domain name of the said Website is also protected under the Trade Mark Law as well as under all applicable laws and provisions governing registration of domain names worldwide. Any confusing or deceptive use or even any attempt thereof shall attract legal action.

LIMITATION OF LIABILITY
1. The said Website has made available the Service as a matter of convenience. DB CORP expressly disclaims any claim or liability arising to the advertiser for any error or omission. The Advertiser irrevocably agrees and acknowledges that he/she shall be solely responsible for his/her conduct and agrees to indemnify and hereby indemnifies the said Website from any legal actions in relation to such acts.
2. In no event shall the said Website be liable for any direct, indirect, punitive, incidental, special or consequential damages or for any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Service for interrupted communications, delay, lost data or lost profits arising out of or in connection with this Agreement.

RESPONSIBILITY

The said Website does not take responsibility of being directly involved in any transaction including SMS and/or any other services between parties using the said Website. The said Website is a platform only and does not screen or censor or otherwise control the listings offered to other Users, nor does the said Website screen or censor or otherwise control the Users of its service.

DISCLAIMER OF WARRANTIES
1. DB Corp has endeavored to ensure that all the information on the said Website is correct, but It neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained. DB Corp also makes no warranty that the Service will meet user's requirements; that the Service will be uninterrupted, timely, secure, or error free; nor does the said Website make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained from the Service;
2. Subscriber agrees that use of the Service is at Subscriber’s sole risk. The Service is provided on an "as is" and on an "as available" basis. The said Website expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of the information contained in the said Website. Similarly, the said Website is not liable for any inaccurate / misleading information given in any advertisement. It is the responsibility of end-user to research / verify / accept bonafide content. 3. In no event, DB Corp shall be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the Services; (b) the cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered into through the Services; (c) unauthorized access to or alteration of the user's transmissions or data; (d) any other matter relating to the Services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the said Website. Neither shall DB Corp be responsible for the delay or inability to use the said Website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the said Website, or otherwise arising out of the use of the said Website, whether based on contract, tort, negligence, strict liability or otherwise.
4. Further, DB Corp shall not be held responsible for non-availability of the said Website during periodic maintenance operations or any unplanned suspension of access to the said Website that may occur due to technical reasons or for any reason beyond DB Corp’s control. The User understands and agrees that any material and/or data downloaded or otherwise obtained through the said Website is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. These limitations, disclaimer of warranties and exclusions apply without regard to whether the damages arise from (a) breach of contract, (b) breach of warranty, (c) negligence, or (d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.
5. The maximum liability on part of DB Corp arising under any circumstances, in respect of any services offered on the said Website, shall be limited to the refund of total amount received from the User for availing the Services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any consequential loss, damage or compensation or additional expense etc.
6. The User also understands that the Services may include certain communications from DB Corp as service announcements and administrative messages. The User understands and agrees that the Services are provided on an "as is" basis and that DB Corp does not assume any responsibility for deletions, mis-delivery or failure to store any user communications or personalized settings.

INDEMNITY

The Advertiser agrees to indemnify and defend, hold harmless, and continues to indemnify the said Website, DB Corp, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including advocates and attorney’s fees, caused by or arising out of claims based upon the use of the Advertiser’s actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfillment of any of its obligations under this Agreement, or arising out of the Advertiser’s infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this Agreement.

GRIEVANCES
1. No liability is accepted for any loss or damage caused by error or inaccuracy in the printing, or omission to insert any advertisement. If any such errors are noticed, the same should be brought to the notice of DB Corp within 15 days from the date of publication in print. No cognizance is taken of complaints received after 15 days. After verification of such complaints received within 7 working days, a free make good insertion/display may be published/displayed, if the compliant is found to be justified. DB Corp shall not be responsible for any other claims or damages.

BREACH OF USER AGREEMENT

Without prejudice to the other remedies available on the said Website under this Agreement, the TOS or under applicable law, DB Corp may limit the User's activity, or end the User's registration, warn other users of the User's actions, and immediately, temporarily/indefinitely suspend or terminate the User's registration, and/or refuse to provide the User with access to the said Website if:
1. the User is in breach of this Agreement,
2. the said Website is unable to verify or authenticate any information provided by the User; or
3. the said Website believes that the User's actions may infringe on any third party rights or breach any applicable law. The said Website may at any time in its sole discretion reinstate suspended users.

FORCE MAJEUR

DB Corp shall have no liability to the User for any interruption or delay, to access the said Website irrespective of the cause. DB Corp shall also not be liable for any failure or delay in delivery of services due to any element of nature or Act of God, fire, flood, earthquake, war, explosion, acts of terrorism, governmental action, riots, insurrection, breakdown of internet connection, power failure, strikes or labour disputes or any act that is beyond the control of DB Corp to reasonably control or restrict in any way whatsoever.

RELATIONSHIP

None of the provisions of this Agreement, Terms and Conditions, notices or the right to use the said Website by the User contained herein or any other section or pages of the said Website and/or the Third Party Sites, shall be deemed to constitute a partnership between DB Corp and the User and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way. All the time during the validity of this Agreement, relationship by and between the Parties herein shall be as Service Provider and Service receiver or as a seller and purchaser and in no other manner.

PRIVACY POLICY
1. The said Website collects information from the Subscribers primarily to ensure and fulfill their requirements and to deliver personalized experience of providing one of the simplest ways for booking advertisements in Newspapers published by DB Corp. The information collected from any of the Subscribers is/are not shared with any individual or organization without the Subscriber’s approval.
2. The said Website does not sell, rent, or loan any identifiable information at the individual level regarding its Subscribers to any third party. Any information given to us by Subscribers is held with the utmost care and security. We are also bound to cooperate fully should a situation arise where we are required by law or legal process to provide information about a user.
3. The said Website may engage in sending promotional material, offers, updates about the said Website and/or other Subscriber’s content, as it may deem fit. By agreeing to the Terms & Conditions, you have given consent for receiving such promotional emails on your registered email ID provided at the time of registration. 4. The User hereby consents, expresses and agrees that the User has read and fully understood the Privacy Policy of DB Corp in respect of use of the said Website and availing services through the said Website. SEVERABLITY

If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

GOVERNING LAW

These Terms & Conditions and the relationship between the Subscriber and the said Website shall be governed by the laws of India, without regard to its conflict of law provisions. The Subscriber and the said Website agree to submit to the personal and exclusive jurisdiction of the courts located at Bhopal, State of Madhya Pradesh.

KYC POLICY

The said Website has made available the Service for publications under D. B. Corp Limited, thus following KYC policies of the company is mandatorily followed, as is, by the portal while Ad bookings in respective cases/categories.
ID Proof: PAN Card
ID and Address Proof: Aadhar, Passport, Driving Licence, Voter ID
Acceptable ID and Address Proof: Person who is booking the Advertisement and registering with his/her name, mobile no. and address is required to provide self KYC documents only, i.e. A can’t book the Advertisement with his/her name, mobile no.& address and upload the KYC of B.
1. Classified AD :- Running and Display Classified:
  Case - 1 - If Bill Amount is less than Rs. 50,000- NO KYC Required
  Case - 2 - If Bill Amount is more than or equal to Rs. 50,000- ID (PAN) and Address Proof is Mandatory.
  (Please note:- here we require two documents i.e 1 - PAN 2 - Address Proof)
  As per IT Act :- Quoting of PAN is mandatory for an amount exceeding Rs. 2 lakh per transaction.
